THE ADMINISTRATION OF ARBITRATIONS UNDER THE UNCITRAL ARBITRATION RULES

The SCC has been involved in arbitrations under the UNCITRAL Arbitration Rules for many years, usually acting as the Appointing Authority. With the SCC Procedures for the Administration of Cases under the UNCITRAL Arbitration Rules (the Procedures) the role of the SCC is to also act as the administering body. 

The SCC main administrative tasks under the Procedures are as follows:

a.    Appointment of arbitrators 
b.    Deciding challenges of arbitrators
c.    Deciding and administering the costs of the arbitration

Parties to a dispute may adopt the Procedures by agreement before or after the dispute has arisen. An arbitration agreement entered into after the 1 January 2015 designating SCC as administrating body includes the role as appointing authority under the UNCITRAL Arbitration Rules, unless the parties agree otherwise.

The SCC maintains different versions of the Procedures depending on which version of the UNCITRAL Arbitration Rules applies to the arbitration agreement (the 1976 version or the 2010 version).
